This data privacy agreement provides information on what happens to your personal data when you visit our website. Personal data is all of the information concerning your person or which can be used to personally identify you.

4. Dealing with personal data

We attach great importance to protecting your privacy. We use information that we obtain and save during your visit to our website for internal purposes and to improve the design of our website. We only save the IP address provided by your web browser for a certain period in order to ascertain, delimit and rectify errors or disruptions (for example attacks on our web server). After this period has expired, we delete or anonymize the IP address. No personal user profiles will be created. Data concerning private individuals or individual behavior will not be collected.

5. Processed data

a.    Provision of the website and creation of log files

When our website is called up, the site’s provider automatically collects and saves information in so-called server log-files, which your browser transfers to us. These are:

-       Date and time of the server enquiry

This data cannot be allocated to any specific person and this data is not merged with other data sources. The log files are saved in order to ensure the website’s functionality and to guarantee the security of our IT systems.

Retargeting

We cooperate with advertising partners based on retargeting technologies. We use these technologies to make the Internet offering more interesting for you. This technology allows us to approach Internet users who have already shown their interest in our website and products on our partners’ websites via interest-based advertising. You can state the restaurant when using the feedback form. All of the personal data provided when performing this activity is used exclusively to execute this activity. The personal data is deleted after the activity ends.

6. Data processing

a.    Permission-based data processing

If you have issued a separate permission, corresponding processing is performed based on Article 6 (1) a of the GDPR. You can revoke your permission at any time without this affecting the legality of any processing previously performed. Separate permission can be provided on our website for the following services: Prize draws, competitions and similar activities – We permanently or temporarily offer the possibility of participating in prize draws, competitions and similar activities via our website. In order to process these activities, personal data such as your e-mail address, term of address, first name, surname, address and any other data which may be required to process the activity may be collected. c.    Data processing to protect vital interests

We process your data in individual cases to protect your vital interests, for example to be able to provide an evacuation list to evacuation personnel in emergency situations. This data processing is performed based on Article 6 (1) d of the GDPR.

 

d.    Data processing for marketing purposes

We process your data for direct advertising purposes, in particular for sending e-mails customized for your trip with information and special offers for everything to do with your trip or for own marketing purposes such as advertising contacts or market analyses. Data is processed based on the current Swiss Data Privacy Act. Everybody has their own personal right to reject this processing, exercising this right leads to processing for direct advertising purposes being terminated. You can reject direct advertising at any time by sending an e-mail to marketing@marche-restaurants.ch. If data is only stored for direct advertising purposes, this data will be deleted after a rejection is submitted.

7. Data recipients

We only send your data to third parties (such as promotion partners) to the extent that there is authorization under data protection law to send this data. What is more, we can also pass on your data to external service providers (such as IT service providers, printing service providers or companies which destroy or archive data) which support us in data processing as part of contract data processing and which strictly follow our instructions.

All of the data processors only receive personal data to the extent that they have authorized data processing and data use, or they only receive this data for the period required in order to provide the services. We will not sell your personal data to third parties or otherwise market this. We do not pass data on to parties who are not involved. This does not apply if we have a statutory requirement to disclose and transfer data or if a court ruling demands this.

8. Data security

In order to ensure that data is transferred securely, it is transferred via a secure TLS connection. Unauthorized third parties thus cannot read your data while it is being transferred. You can recognize the TLS-protected pages in that the address does not start as usual with http://, but with https://. In addition, most browsers show a lock symbol and/or the word “secure”.

9. Your rights

a.    Right to information/deletion

Affected persons are entitled to information on the personal data relating to them and to the correction of inaccurate data or to deletion to the extent that one of the reasons stated in Article 17 of the GDPR is present, for example if data is no longer required for the purposes being pursued. In addition, there is a right to processing being restricted if one of the reasons stated in Article 18 of the GDPR is present and, in the cases stated in Article 20 of the GDPR, the right to data transferability.

 

b.    Right of opposition

If data is collected based on Article 6 (1) e or f, the affected person has the right to submit an objection to processing at any time based on reasons resulting from their specific situation. We then no longer process personal data, unless there are verifiable, mandatory reasons meriting protection for processing which outweigh the interests, rights and freedoms of the affected person, or if processing serves to assert, exercise or defend legal claims.

 

c.    Complaints to the supervisory authority

In the event that data privacy is violated, you have a right to complain to the Federal Data Protection Commissioner.
